With this lawsuit resulted the now famous Brown vs. So, the Brown family along with a dozen other black families took the Education Board to the court, asking for a reason why their children had to travel far to attend school while there's a school nearby too.

But contrary to this, the Brown family had to endure the same said segregation in the case of sending their daughter Oliver Brown to a segregated school far from home instead of the nearby school. The Fourteenth Amendment of the Constitution states that no person shall be deprived of ' life, liberty, or property, without due process of law nor deny to any person within its jurisdiction the equal protection of the laws'.

The Brown case addresses whether the plaintiff has been afforded equal protection of the laws relative to those attending public schools.
